GenBatcher — Batch AI Image Generation

These Terms of Service ("Terms") govern your use of the GenBatcher web application at genbatcher.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

GenBatcher is a batch AI image generation service. You submit image generation requests (via CSV upload or the web interface), and the Service processes them asynchronously using third-party AI models, currently Google Gemini. Generated images are stored and made available for download.

2. Accounts and Authentication

2.1 Account Creation

To access the full Service, you must create an account via our authentication provider, WorkOS. You are responsible for maintaining the security of your account credentials.

2.2 Preview Mode

Anonymous users may try the Service without creating an account. Preview mode is limited to 10 generated images per session and one preview per IP address per month. Preview batches may be claimed by creating an account.

2.3 Account Responsibility

You are responsible for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorized use of your account.

3. Subscription Plans and Billing

3.1 Plans

The Service offers subscription-based access with the following tiers:

Starter ($19/month) — 500 images per month, 30-day image retention
Pro ($49/month) — 1,500 images per month, 90-day image retention
Business ($149/month) — 6,000 images per month, 180-day image retention

3.2 Payment Processing

All payments are processed by Polar.sh, which acts as the Merchant of Record. By subscribing, you also agree to Polar.sh's terms of service and privacy policy. GenBatcher does not directly collect or store your payment information.

3.3 Billing Cycle

Subscriptions are billed monthly. Your image generation allowance resets at the start of each billing period.

3.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you retain access to the Service until the end of your current billing period. After that, your access reverts to the limitations of an unsubscribed user, and generated images will be deleted according to your plan's retention schedule.

3.5 Refunds

Refund requests are handled by Polar.sh as the Merchant of Record, in accordance with their refund policy and applicable consumer protection laws.

4. Acceptable Use

4.1 You Agree Not To

Use the Service to generate illegal, harmful, abusive, defamatory, or obscene content
Submit prompts designed to produce content that violates the rights of others, including intellectual property rights
Attempt to circumvent usage limits, rate limiting, or bot protection measures
Use the Service in a way that disrupts or degrades the experience for other users
Reverse-engineer, decompile, or attempt to extract the source code of the Service
Use automated tools to access the Service in a manner not authorized by these Terms
Resell access to the Service without our written consent
Use the Service to generate content depicting child sexual abuse material (CSAM) or any content that sexualizes minors

4.2 Content Moderation

The AI models used by the Service may have built-in content filters and safety mechanisms. We reserve the right to refuse, remove, or restrict access to content that violates these Terms, applicable law, or the AI provider's usage policies. Generation requests that are rejected by the AI provider will be marked as failed.

4.3 Enforcement

We may suspend or terminate your account if you violate these Terms. Serious violations (including any attempt to generate CSAM) will result in immediate termination without notice.

5. Intellectual Property

5.1 Your Content

You retain ownership of the prompts you submit and any original creative input you provide. Ownership and licensing of AI-generated images are subject to the terms of the underlying AI model provider (currently Google's Gemini terms of service). We recommend reviewing the AI provider's terms for details on usage rights for generated images.

5.2 Our Service

The Service, including its design, code, and documentation, is owned by GenBatcher and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

5.3 License to Us

By uploading content to the Service, you grant us a limited, non-exclusive license to process, store, and transmit that content solely for the purpose of providing the Service to you. We do not use your prompts or generated images for any other purpose, including training AI models.

6. Data, Privacy, and GDPR

6.1 Privacy Policy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. Please read it carefully.

6.2 Data Retention

Generated images are automatically deleted after your plan's retention period expires. Upon account deletion, all associated personal data is deleted in accordance with our Privacy Policy.

6.3 Data Export

You may export your batch data in CSV format at any time. You may download your generated images during the retention period.

7. Service Availability and Limitations

7.1 No Guarantees

The Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted availability, error-free operation, or that all image generation requests will succeed. Image generation depends on third-party AI providers whose availability and behavior are outside our control.

7.2 Fair Use

Subscription limits (images per period) are enforced at both the API level and during processing. Attempts to exceed these limits will be rejected.

7.3 Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. If we make material changes that negatively affect your subscription, we will provide reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

GenBatcher is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
GenBatcher's total liability for any claim related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.
GenBatcher is not liable for any losses arising from the unavailability of third-party services (AI providers, authentication, payment processing), data loss due to infrastructure failures, content generated by AI models that is inaccurate, offensive, or otherwise undesirable, or actions taken by AI providers' content moderation systems.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

9. Indemnification

You agree to indemnify and hold harmless GenBatcher from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or content you generate through the Service.

10. Termination

10.1 By You

You may stop using the Service at any time. You may request account deletion by contacting us at [email protected].

10.2 By Us

We may suspend or terminate your access to the Service at any time for violation of these Terms, prolonged inactivity, or at our discretion with reasonable notice.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your generated images will be deleted according to the applicable retention schedule. Data deletion upon account closure is handled as described in our Privacy Policy.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of Switzerland. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Vaud, Switzerland.

If you are a consumer within the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GenBatcher regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

12.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

12.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights and obligations freely.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
